Notice is hereby given that the Board of Trustees adopted a local law opting out of permitting and establishing retail cannabis dispensaries and on-site cannabis consumption which is subject to a permissive referendum.
This Local Law is subject to a permissive referendum pursuant to Section 24 of the Municipal Home Rule Law and §9-902(1) of the N.Y. Village Law. A complete copy of the approval resolution and local law summarized herewith is available for public inspection during regular business hours at the Office of the Village Clerk. A petition, to be valid, must be submitted within thirty (30) days of the date of adoption of the resolution.
PURSUANT TO CANNABIS LAW § 131, OPTING OUT OF LICENSING AND ESTABLISHING RETAIL CANNABIS DISPENSARIES AND ON-SITE CONSUMPTION ESTABLISHMENTS IN THE VILLAGE OF IRVINGTON
Be it enacted by the Board of Trustees of the Village of Irvington as follows:
Section 1: Legislative intent. It is the intent of this local law to opt the Village of Irvington out of permitting retail cannabis dispensaries and on-site cannabis consumption establishments within its boundaries.
Section 2: Authority. This local law is adopted pursuant to § 131 of the Marihuana Regulation and Taxation Act (MRTA).
Section 3: Opt-Out. No cannabis retail dispensary and no cannabis on-site consumption establishment is permitted in the Village of Irvington.
Section 4: All ordinances, local laws, and parts thereof inconsistent with this local law are hereby repealed.
Section 5: This local law shall take effect upon filing with the Secretary of State. As required by the MRTA, the local law is subject to a permissive referendum and, therefore, may not be filed with the Secretary of State until 30 days have elapsed after enactment of this local law or, if a petition is filed within that period, until a referendum has been conducted approving this local law.
